No seizure if the Tch level does not exceed 0.5%. This is the sentence issued by the Genoa Review Court regarding cannabis light. The judges' decision is the first after what was established by the Supreme Court on May 30, which wrote in black and white that the law does not allow the sale or transfer of products "derived from the cultivation of cannabis", such as oil, leaves, inflorescences and resin.

The story arises from the seizure in a shop in Rapallo, last June 3, of inflorescences, vials of oils, packets of herbal teas and leaves based on hemp sativa. The trader, defended by the lawyer Salvatore Bottiglieri, had opposed it by turning to the Review. The judges ruled in his favor and ordered the return of the goods. According to the Genoese judges, there is no rule that establishes the percentage of active ingredient that makes a product psychotropic.
Stop cannabis sativa
The Court of Cassation has established that products containing cannabis sativa but without doping properties can be sold. The only reference, at the moment, is a 2018 circular from the Ministry of the Interior, interpreting law 242 of 2016, which says that inflorescences exceeding 0.5% are included among narcotic substances. This percentage, underlines the Review, "remains the only parameter for potential psychotropic efficacy". For this reason, the prosecutor cannot seize all the goods but, in case of doubt, take individual samples to analyze and, in case of a higher threshold, at that point proceed with the seizure
