Victory for hemp in Italy. With a precautionary ruling, the Council of State he suspended the measure again which inserted the CBD in the list of narcotic drugs (table of medicines, section B).
What does this mean for the sector? Is light cannabis safe? Let's clarify.

Amazing CBD: the decision of the State Council
It was October 2020 when the former Minister of Health Roberto Speranza decides to issue the first measure aimed at including CBD compositions for oral use in the list of narcotic drugs.
Provision that incites doctors, patients, associations and sector operators, leading to suspension of the decree at the end of October 2020.
However, just a few years from now, the decree is proposed again practically identical to the Meloni government in 2023. And as then, suspended again by the TAR. With the sentence expected in September of that year.
The celebrations, however, do not last long. Because the government, not happy, in summer 2024 issues a new decree with the same objective: to include CBD among narcotics.
Decree that finally comes into force. But the associations do not give up and appeal to the Council of State. That yesterday suspended him as a precaution.
With the sentence expected for May 7, 2026.
A small victory that (for now) is not enough
The hemp sector in Italy finds itself in a unique situation of its kind.
Because if on the one hand there is the Council of State which has suspended the decree on the CBD, on the other hand there is still the Security Decree.
In particular Article 18, which inserts in Table II e considers hemp inflorescences amazing and its derivatives, even if they derive from certified European varieties and with a minimum percentage of THC lower than 0.2%.
There is therefore an obvious paradox. Which will be dissolved once and for all by Court of Justice of the European Union: responsible for clarifying whether a member state, in this case Italy, can apply autonomous restrictions on hemp or not.
