The TAR of Lazio he suspended the decree which included CBD-based oral compositions in the table of medicines, section B of the consolidated law on narcotics.
The suspension is valid until October 24th next, comes following the initiative of the Canapa Italia Entrepreneurs association, which, with the support of the law firm Prestige Legal & Advisory, presented the appeal to the Lazio Regional Administrative Court.

CBD: the Lazio TAR has suspended the decree
It's one victory for the Italian hemp sector which could be hit hard by this measure, as was already happening since September 21st, when the decree entered into force.
In fact, the precautionary suspension of the decree on CBD occurred after several seizures occurred in shops, including products such as light cannabis or cosmetics, which were not affected by the provision at all.
“In order to avoid serious and irreparable damage to the entire sector, the Lazio, Rome TAR accepted the request for suspension of the Ministerial Decree of 7.8.2023 formulated by ICI - declares Raffaele Desiante, President of ICI, explaining that - Considering that, having regard to what has been deduced on the point of appeal as well as the attached documentation proving the seizure and closure of the businesses, it is believed that the conditions for granting the requested monocratic precautionary application pursuant to art. 56 c.p.a. pending collegial discussion".
“The suspension is necessary, also in light of what happened after it came into force, with indiscriminate seizures of everything, flowers, oils and products, without distinction - highlights the lawyer Giacomo Bulleri - It is certainly confirmation of the fact that it is an anti-scientific measure, because it made no sense to include it in the table of narcotic medicines even though it can be considered a drug, and then anti-legal, given that community legislation must be respected. In Europe there is an ongoing process of alignment and therefore retreats do not help the stability of the market".
